جريمة الاتّجار بالأعضاء البشرية في قانون العقوبات الجزائري

Résumé: تعد جريمة الاتجار بالأعضاء البشرية من السلوكيات الحديثة التي تمس بكرامة الإنسان في المجتمع ككل، والجدير بالذكر أنها سرعان ما انتشرت وأضحت تقودها جماعات إجرامية منظمة وأصبحت لها سوق سوداء عالمية بسبب كثرة الطلب على الأعضاء البشرية القابلة للزرع -بسبب تعدد الأمراض وتنوعها وانتشارها- الذي يفوق العرض، ولهذا تفطنت كل الدول لخطورتها وقامت التشريعات بتجريمها ووضع عقوبات لها، من بينها المشرع الجزائري الذي فصل في تجريم هذا السلوك وبين صوره ووضع العقوبات التي يراها مناسبة لتسليطها على كل من له ضلوع في ارتكابها أو الشروع فيها مع تحديده للظروف التي تشدد العقوبة ونصه على عدم استفادة المدان في الاتجار من أي ظرف مخفف، كما أنه لا يستفيد من كل تلك التدابير العلاجية التي تساعد المجرم في خلع رداء الجريمة أثناء مغادرة باب المؤسسة العقابية. : Abstract: The crime of trade of human organs has become one of modern behaviors that affect human dignity in the community as a whole. This phenomenon has become led by organized criminal groups which runs a black market because of the large demand of human organs transplant rechargeable because of the multiplicity, diversity and the spread of diseases this demand become more than the supply. For this, all states knew the danger of this phenomenon so they enacted laws to criminalize and punish all who does this. Among these countries, we find the Algerian legislator who makes this behavior a crime, explain their forms, puts strict penalties and appropriate to each one who participated in commit or attempted the crime with more severe punishment, not take advantage convicted in this trade from commutation procedures and do not benefit from all those remedial measures that help the offender to take off the robe crime while leaving the door penal institution.
