جدلية الشخصية القانونية للذكاء الاصطناعي

Résumé: باتباع منهج علمي تحليلي تناولت هذه الدراسة جدلية الشخصية القانونية للذكاء الاصطناعي، واختلاف الآراء القانونية حولها منعاً أو منحاً، أو استقلالها بشخصية ذات طبيعة خاصة، وتدور إشكالية الدراسة حول مدى إمكانية منح الذكاء الاصطناعي شخصية قانونية مستقلة والاعتراف لها بكافة الحقوق وتحميلها كافة الالتزامات. وتوصلت الدراسة إلى أن الاعتراف للذكاء الاصطناعي بالشخصية القانونية في الوقت الحالي يُشكَّل خطورة كبيرة قد تُؤدّي إلى تنصل منتجي ومستخدمي تقنيات الذكاء الاصطناعي عن مسؤولياتهم، وبالتالي، اتساع نطاق الأضرار الناشئة عن الذكاء الاصطناعي دون وجود آليةٍ قانونيةٍ عادلةٍ لجبر المضرورين من مخاطرها. Abstract: By following an analytical scientific approach, this study addressed the legal personality controversy of artificial intelligence, and the different legal opinions regarding whether it should be granted or denied, or have an independent personality of its own. The problem of the study revolves around the possibility of granting artificial intelligence an independent legal personality and recognizing it with all rights and obligations. The study concluded that recognizing artificial intelligence with legal personality at the present time poses a great danger that may lead to producers and users of artificial intelligence technologies avoiding their responsibilities, thus widening the scope of damages resulting from artificial intelligence without a fair legal mechanism to compensate those harmed.
