Résumé: بسم الله الرحمن الرحيم، والصلاة والسلام على سيدنا محمد خاتم الأنبياء والمرسلين، أما بعد: المقال تحت عنوان: "الزواج عن طريق وسائل الاتصال الحديثة –دراسة مقارنة بين أحكام الشريعة الإسلامية والقانون الجزائري-"، حيث أبرزنا فيه رؤية الفقه الإسلامي المعاصر في مسألة مستجدة ألقت بظلالها على المجتمع الإسلامي، وانتشرت بكثرة حديثا وهي الزواج عن طريق وسائل الاتصال الحديثة، حيث وجدنا خلاف بينهم حول هذه المسألة، أما المشرع الجزائري ورغم ما تثيره هذه المسألة من اشكالات كما سنوضحه لاحقا إلا أنه تغافل عنها تماما في قانون الأسرة الجزائري مما جعلها تشكل ثغرة قانونية عميقة. وكان من أبرز التوصيات التي خلص إليها البحث أنه على المشرع الجزائري مواكبة تطور الاجتهاد الإسلامي وذلك بتحديد موقفه من مسألة الزواج بوسائل الاتصال الحديثة، وتحديد جميع أحكامه بموجب قانون الأسرة الجزائري وذلك استنادا إلى الراجح من أقوال مجتهدي الفقه الإسلامي المعاصر. In the name of God the Most Gracious the Most Merciful, the prayers and peace be upon our master Muhammad the Seal of Prophets and Messengers, Which was titled "Marriage through Modern Means of Communication - A Comparative Study between the Provisions of Islamic Law and Algerian Law", where we highlighted the view of contemporary Islamic jurisprudence in an emerging issue that cast a shadow over the Islamic community. , Where we found a disagreement on this issue, but the Algerian legislator and despite the issue raised by this issue as we will explain later, but it is completely ignored in the Algerian family law, making it a legal loophole deep. One of the most important recommendations of the research was that the Algerian legislator should keep abreast of the development of Islamic jurisprudence by determining its position on the issue of marriage through modern means of communication and determining all its provisions under Algerian family law based on the most correct statements of contemporary Islamic jurists.
