المشتقات المالية من منظور إسلامي كبديل للمشتقات المالية الوضعية في أسواق الأوراق المالية الإسلامية

Résumé: شهدت أسواق الأوراق المالية في كل دول العالم عولمة مالية كبيرة ، و من مميزات هذه العولمة المالية درجة الترابط الكبير بين معظم أسواق الأوراق المالية ، إذ أصبحت كل الأسواق و كأنها سوق واحدة عالمية مفتوحة لكل المتعاملين، كما شهدت أسواق الأوراق المالية تطورات في الصناعة المالية و إبتكرات من خلال الهندسة المالية ، لكن هذه الإبتكرات كانت لها أيجابيات و سلبيات، إذ كانت في غالب الأحيان السبب المباشر أو غير المباشر في الكثير من الأزمات المالية المعاصرة، مما فتح الباب أمام ظهور المعاملات المالية الإسلامية التي أثبتت متانتها و قوتها في معالجة الأزمات و إيجاد حلول تمويلية و إستثمارية بما يتوافق مع أحكام الشريعة الإسلامية ، و خير دليل على ذلك هو تبنيها من طرف كثير من الدول غير الإسلامية، إلا أن الصناعة المالية الإسلامية أمام تحدي التطور و الإبتكار في ظل القيود الشرعية أو ما يمكن أن نسميه الهندسة المالية الإسلامية التي تسمح بتوفير الحلول التمويلية و الإستثمارية وفق القيود الشرعية ، وهذا ماسوف نعالجه من خلال هذه الورقة البحثية. الكلمات المفتاحية: أسواق الأوراق المالية ،الهندسة المالية، المعاملات المالية الإسلامية، الهندسة المالية الإسلامية Abstract: The securities markets all over the world have witnessed a significant financial globalization. The financial globalization is characterized by a great degree of connection between most of the securities markets. All such markets have turned to be as one open world market for all traders. The securities markets as well have witnessed several developments in the financial industry and innovations through the financial engineering. However, these innovations have had pros and cons and in most cases they were the direct or indirect cause of various contemporary financial crises. Thereby the door has been broadly open for emergence of Islamic financial transactions that have demonstrated durability and strength in addressing the crises and finding financing and investment solutions in conformity with the Islamic Sharia Regulations. The best evidence is their being adopted by many non-Islamic countries. However, the Islamic financial industry is face to face with the challenging developments and innovations under the Sharia restrictions or what may be called the Islamic Financial Engineering that paves to way for provision of financing and investment solutions pursuant to the Sharia restrictions which will be addressed through this paper.
