النقد الفقهي عند ابن العربي "منهجه وقواعده" من خلال كتاب أحكام القرآن القضاء أنموذجا

Résumé: تهدف هذه الدراسة إلى الكشف عن جانب من المنهج النقدي عند أبي بكر بن العربي من خلال كتابه أحكام القرآن غير أن هذه الدراسة ليست منصبة على كل الكتاب وإنما مقيدة بآيات الأحكام المتعلقة بالقضاء، وقد ركزت فيها على إبراز أهم الأدوات التي ارتكز عليها أثناء نقده. وخلصت الدراسة إلى أن ابن العربي كان له منهجا نقديا بديعا تتجاذبه الصنعات بأنواعها الفقهية، والأصولية، والحديثية، والتفسيرية، وغيرها. This study aims to reveal an aspect of the critical approach of Abu Bakr ibn al-Arabi through his book Ahkam al-Qur’an. However, this study is not focused on the entire book, but rather is restricted to verses of rulings related to the judiciary, and it has focused on highlighting the most important tools that he relied on during his criticism. The study concluded that Ibn al-Arabi had a wonderful critical approach that was attracted by various types of jurisprudence, fundamentalism, hadith, exegesis, and others.
