آثار إخلال المصلحة المتعاقدة بالتزاماتها عند تنفيذ الصفقة العمومية

Résumé: تعتبر الصفقة العمومية عقدا إداري ينعدم التكافؤ بين طرفيه، إذ يُمنح فيها للمصلحة المتعاقدة امتيازات السلطة العامة، و يرجع ذلك إلى ما تهدف إليه الصفقة من تحقيق المصلحة العامة، إلا أن هذه الصفقة هي عقدا مثل جميع العقود، تتضمن حقوق والتزامات متبادلة بين المتعاقدين يقع على عاتق كل طرف تنفيذ ما يقع عليه. و بالتالي أي إخلال بتنفيذ الالتزامات التقنية أو المالية من جانب المصلحة المتعاقدة - لا مبرر له بامتيازات السلطة العامة – يترتب عليه آثار تنتج حقوقا لصالح المتعامل المتعاقد.The public transaction is an administrative contract where there is no parity between its two parties, As the contracting interest is granted the prerogatives of public authority, This is due to the aim of the deal in terms of achieving the public interest, Except that this deal is a contract like all contracts, It includes reciprocal rights and obligations between the contracting parties. It is the responsibility of each party to implement what falls on it. Consequently, any breach of the implementation of technical or financial obligations on the part of the contracting authority, Unjustified by the privileges of public authority, It has effects that produce rights in favor of the contracting client.
