الموازنة بين مبدأ سلطان الارادة وأحكام المسؤولية المدنية في مفاوضات عقود التجارة الدولية

Résumé: ملخص: تتم اغلب المفاوضات في عقود التجارة الدولية في إطار عقدي يترتب عليها التزامات بالنسبة لكلا الطرفين ، و مع امكانية عدول الاطراف المتفاوضة عنها، فانه من الضروري احداث موازنة بين الاعتراف للمتفاوض بحرية العدول عن المفاوضات وقطعها طبقا لمبدأ سلطان الإرادة ، من جهة ، ووجوب توفير حماية قانونية للطرف الآخر وفقا لأحكام المسؤولية العقدية و التقصيرية، من جهة اخرى، وفي هذا الصدد تقوم المسؤولية المدنية بدور ايجابي و فعال في مرحلة التفاوض في عقود التجارة الدولية، حيث تساهم بشكل كبير في تحقيق الأمن و طمأنينة للأطراف المتفاوضة. الكلمات المفتاحية : مفاوضات؛ عقود التجارة الدولية ؛المسؤولية العقدية؛ المسؤولية التقصيرية. Abstrect: Most of the negotiations in international trade contracts take place within a contractual framework that entails obligations for both parties, and with the possibility of the negotiating parties reversing them, it is necessary to strike a balance between the recognition of the negotiator the freedom to abandon negotiations and break them according to the principle of the power of will, on the one hand, and the obligation to provide legal protection For the other party in accordance with the provisions of contractual and default liability, on the other hand, and in this regard, civil liability plays a positive and effective role in the negotiation stage of international trade contracts, as it greatly contributes to achieving security and reassurance for the negotiating parties.
