مراعاة المقاصد في أحكام النوازل الفقهية من خلال كتاب المعيار المعرب للإمام الونشريسي أحكام الأسرة أنموذجا-

Résumé: تناول هذا البحث عنوان مراعاة المقاصد في أحكام النوازل الفقهية من خلال كتاب المعيار المعرب للإمام الونشريسي -أحكام الأسرة أنموذجا- ، وقد جاء هذا البحث مقسما إلى ثلاثة مباحث، كان أولها مبحثا تمهيديا حول حياة الإمام الونشريسي، ثم دراسة كتابه المعيار المعرب، بينما عني المبحث الثاني بدراسة مفهوم النوازل الفقهية حيث تم فيه تعريف النوازل الفقهية والألفاظ ذات الصلة بها ثم ذكر أهمية دراسة النوازل الفقهية، بينما تطرقت في الشق الثاني منه إلى علاقة النوازل الفقهية بمقاصد الشريعة وتم فيه تعريف المقاصد وأدلة اعتبارها ثم العلاقة القائمة بينهما حيث تم فيها ذكر أهم العناصر الجوهرية للبحث، ليخلص المبحث الثالث بذكر بعض المسائل التطبيقية في أحكام الأسرة من خلال نوازل المعيار. This research studied the observance purposes in terms of calamity through doctrinal book of the Arabized standard by Alonansharissi – familyprovisions- as a model. This the first of which ،research is divided into three chapters was a preliminary study about the life of Imam then the study of his book the ،Alonansharisi while the second section is meant to ،Arabizedstandard study the concept of calamity doctrinal terms. The second part defines the relationship between doctrine what was as the most important ،written and the purposes of Sharia it tries ،core elements to be looked at. As for the third topic to find some applications issues in terms of the family through its standards.
