النقد الأصولي عند ابن كمال باشا (ت940ه) من خلال كتابه (تغيير التنقيح) -منهجه ومجالاته-

Résumé: ملخص: يُعتبر العلامة ابن كمال باشا (ت940ه) من العلماء المبرّزين في القرن العاشر؛ إذ هو عالمٌ متفنِّنٌ له مشاركات بعدّة علوم، ومن ذلك علم أصول الفقه الذي ألّف فيه كتابه النافع (تغيير التنقيح)، وقد وضعه تهذيبا ونقدا واستدراكا على تنقيح صدر الشريعة (ت747ه)، ولما تميّز كتابه هذا بهذه الصبغة العلمية النقدية، وكانت جوانب الشخصية العلمة الأصولية للعلامة ابن كمال باشا مغيّبة عن الوسط العلمي، جاء هذا البحث بهدف إبراز جانب من جوانبها، وهو النقد الأصولي لديه. وقد تحصّل من خلال هذا البحث أن ابن كمال باشا من الأصوليين الذين كانت لهم نزعة نقدية ظاهرة، فلا تكاد تخلو مسألة من مسائل كتابه إلا وفيها ردٌّ أو استدراكٌ على صاحب التنقيح، أو غيره من الأصوليين، كما يظهر أن مجالات نقده قد شملت معظم مباحث أصول الفقه، وكان ذلك بعبارة وجيزة تدلّ على التدقيق والتحقيق دون جنوح منه إلى الإسهاب، مع حرصه على بيان الدليل والتعليل لما يذكره من الانتقادات. Abstract: Ibn Kamel Pasha (d.940 AH) is considered one of the distinguished scholars in the tenth century; for he is a multi-knowledge scholar zith contributions in several sciences including the jurisprudential assets which he wrote his beneficial book (Taghier El-Tankeeh), and when this book characterized by a brilliant scientific critical nature, and when were the aspects of jurisprudential personality of Ibn Kamel Pasha absent from the scientific field, this research came with the aim of highlighting one of these aspects which is the jurisprudence criticism of him. It was achieved through this research that Ibn Kamel Pasha was one of the jurisprudential who had an obviously critical tendency, for there is hardly an issue in his book without a response or rectification, it also appears that his criticism covered most issues with a brief phrase indicating his scrutiny, and his keenness to provide the reasoning causes for the criticism he mentions
