آليات حل المنازعات المتعلقة بعقد التأمين البحري

Résumé: يعتبر عقد التأمين البحري من بين أقدم مجالات التأمين ، حيث ازدهر عن طريق المعاملات المختلفة لحركة الملاحة البحرية ، التي أدت إلى تطور اقتصاديات النقل البحري ، فنتج عن ذلك منازعات مختلفة ، و لتسويتها استلزم إيجاد آليات غير قضائية من أجل تنفيذ عقد النقل البحري بطرق ودية ، أو عن طريق التحكيم . و من جهة أخرى يمكن التسوية بإيجاد آليات قضائية تتمثل في دعوى الخسارة و دعوى الترك ، الأولى هي الطريقة العادية للمطالبة بتعويض التأمين الذي يعتبر الأصل حيث يجوز للمؤمن له استعمالها في كل المخاطر أيا كانت أهميتها ، أما دعوى الترك فهي طريق استثنائي محض خاص بالقانون البحري ، ذلك لأنه يضم أنظمة خاصة به و التي تتمثل في نظام المساهمة في الخسائر المشتركة و نظام التخلي . The marine insurance contract is among the oldest fields of insurance , it prosper through the different transactions of the maritime navigation movement , which led to the development of maritime transport economics; resulting from it many disputes ;and order to settle it , it was necessary to find non- judicial mechanisms to implement the maritime transport contract with friendly ways , or by arbitration contract . on the other hand ; it is possible to settle it by finding judicial mechanisms represented in the loss and abandonment lawsuit . the first is the regular way to claim insurance compersation which is the original where the insured may use it in all risks whatever their importance ; as for the abandonment lawsuit ; it is a purely exceptional rod for marine law ;this is because it includes its own systems which are represented in the system of contributing to joint losses and the abandonment system .
