الضوابط القانونية للفحوصات ماقبل الولادة (دراسة مقارنة)

Résumé: الفحوصات التي تخضع لها اللقيحة أو الجنين، تجوز من الناحية القانونية لتوافر المصلحة العلاجية، والتي تتمثل في تفادي ولادة طفل مُصاب بمرض أو تشوه خطير يصعب علاجه عند الميلاد، إذ تهدف هذها الدراسة إلى تنظيم هذا النوع من الممارسات الطبية بوضع أطر وضوابط قانونية تحول دون إساءة استخدام هذه الوسائل، نحو أغراض أخرى بهدف تحسين النسل أو انتقاء الجنس المولود. وتوصلت هذه الدراسة إلى أن المشرع الجزائري لم يواكب التطور العلمي الحديث في مجال طب الأجنة، الأمر الذي يفرض عليه كغيره من تشريعات الدول المقارنة، قبل الترخيص بإجراء هذا النوع من الممارسات، تأطيرها بنصوص تشريعية وتنظيمية صريحة، وبضوابط وقيود محددة، وعقوبات جنائية رادعة، تمثل رقابة فعالة تكفل عدم الانحراف عن الغرض الأساسي منها. Abstract: The examinations to which the inoculum or fetus are subjected; legally permissible due to the availability of the therapeutic interest, to avoid the birth of a child with a serious disease or deformity that is difficult to treat at birth this study aims to regulate this type of medical practices by establishing frameworks and legal rules, wich prevents the misuse of these means to Improve the offspring or selecting the sexe of the child This study concluded that the Algerian legislator did not keep pace with the modern scientific development in the field of fetal medicine, which imposes it, lie other legislation of comparative countries, before licensing this type of practice, framing it with explicit legislative and regulatory texts, with specific rules and restrictions, and deterrent criminal penalties, which represent effective control that ensures not deviate from the main purpose
