ملامح التحول في نمط الرقابة على دستورية القوانين في الجزائر - دراسة على ضوء أحكام التعديل الدستوري لسنة 2020- Features Of The Shift In The Pattern Of Control Over The Constitutionality Of Laws In Algeria: A Case Study In The Light Of The Provisions Of The Constitutional Amendment (2020)

Résumé: تسعى الدراسة إلى فرز ملامح الطبيعة القانونية للرقابة على دستورية القوانين في الجزائر وذلك على ضوء الانعكاسات التي أحدثتها أحكام التعديل الدستوري لسنة 2020 وما حملته من تغييرات جديدة مست هوية القضاء الدستوري، وهذا من خلال مقاربة أساسية مفادها أن معيار تحديد هذه الطبيعة يبدأ بالدرجة الأولى من التسمية التي تحملها الهيئة التي أسندت لها مهمة الرقابة وكذا التشكيلة والمهام المسندة لها. وقد أكدت الدراسة أن أي تغيير في نمط الرقابة على دستورية القوانين تتحكم فيه عدة ضوابط أهمها حدوث تغيير في تسمية الهيئة التي تسهر على هذه الرقابة، وأن يتم تزويد الهيئة الرقابية بأساليب الرقابة القضائية كتبني أسلوب الدعوى الأصلية باعتبارها أنجع نماذج الرقابة القضائية على دستورية القوانين . The present study attempts to define the features of the legal nature of oversight of the constitutionality of laws in Algeria in the light of the repercussions caused by the provisions of the constitutional amendment of the year 2020, and the new changes it brought about in the identity of the constitutional judiciary. This; in fact, is done through a basic approach that the criterion for determining this nature begins; primarily, with a designation carried by the body that was assigned the task of oversight, as well as the composition and tasks assigned to it. Moreover, the study confirmed that any change in the pattern of control over the constitutionality of laws is controlled by several controls, in which it is not sufficient only to change the name of the body that oversees this control; however, this body should tend to adopt the method of the original case as the most effective model of judicial control over the constitutionality of laws.
