التجريم الوقائي كألية للمسألة الجنائية لمخالفي تدابير الحجر الصحي وتعريض الغير للخطر بنقل عدوى كوفيد19-دراسة على ضوء مستجدات قانون العقوبات الجزائري

Résumé: لا تعاقب القواعد العامة في قانون العقوبات على السلوك الخاطئ طالما لم يترتب عليه أي نتيجة ،وهذا القول يجد مجاله الخصب في السلوكات الخاطئة التي يرتكبها الأشخاص الخاضعين لتقيدات الحجر الصحي المنزلي ، إذ يؤدي خرق هذا الحجر وعد إحترام تدابير الوقاية الى تعريض الآخرين لخطر عدوى فيروس كورونا المستجد مع إفلاتهم من المسألة الجنائية بسبب عدم تحقق النتيجة الإجرامية . ولان وباء كورونا (covid19) يشكل تحديا عالميا يتطلب من كل شخص سلوكا مسؤولا من أجل التصدي للفيروس وإحتوائه .وعليه فإن كل من يخالف تدابير الحجر الصحي المنزلي الذي يمثل بوابة للقضاء على الفيروس في ظل غياب تلقيح أو دواء له يعرض حياة الآخرين للخطر بنقل العدوى تستوجب مسألته جنائيا ، تجد هذه المسائلة أساسها في سياسة التجريم الوقائي المبنية على أساس منع التعريض للخطر قبل إلحاق الضرر بالمصالح المحمية قانونا General rules in the Penal Code do not penalize wrong behavior as long as it does not have any result, and this saying finds its fertile field in the wrong behavior committed by people subject to the restrictions of domestic quarantine, as breaching this stone and the promise of respecting preventive measures exposes others to the risk of corona virus infection The newcomer with escaping the criminal matter because the criminal result has not been achieved. And because the Corona epidemic (covid19) poses a global challenge that requires each person a responsible behavior in order to address the virus and contain it. Accordingly, everyone who violates the measures of domestic quarantine that represents a gateway to eliminate the virus in the absence of vaccination or medicaments that endangers the lives of others at risk by transmitting the infection requires criminally, this issue finds its basis in a preventive criminalization policy based on the prevention of endangering before harming legally protected interests
