Résumé: تبرز أهمية العقار الفلاحي باعتباره أحد أهم القطاعات الرئيسية في البناء الاقتصادي، الاجتماعي والسياسي لمعظم الدول، خاصة وأنه يلعب دوراً هاماً في التنمية الاقتصادية، حيث لا يهدده الزوال الذي تتعرض له الثروات الأخرى مثل المحروقات، ما جعل من المشرع الجزائري يبادر إلى إعادة الاعتبار له من خلال أحكام القانون رقم 10-03، يحدد شروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، محاولةً منه إلى تفعيل استغلاله بطريقة تعمل على الارتقاء به، في مقابل احتفاظ الدولة بملكيته، باعتباره ملكا للجماعة الوطنية، لا يقبل التنازل ولا الكسب بالتقادم.
