الشهادة الطبية كضمانة لحماية المريض العقلي في التشريع الجزائري وفقا لقانون الصحة والقواعد العامة
Résumé: الملخص: يعتبر الحق في سلامة الصحة العقلية من بين أهم الحقوق الأساسية للإنسان، أكد عليه المشرع الجزائري بموجب قانون الصحة رقم 18/11 المؤرخ في 02/07/2018، أين خول لطبيب الأمراض العقلية بالمؤسسة الاستشفائية الحق في تحرير الشهادة الطبية الخاصة باستشفاء المرضى المصابين باضطرابات عقلية. ولهذا انصبت هذه الدراسة على إبراز دور الشهادة الطبية في حماية المريض العقلي في التشريع الجزائري طبقا للقانون الصحي والقواعد العامة. Abstract: The right to the integrity of mental health is among the most basic human rights, confirmed by the legislator Algerian under Health Law N:º 18/11 dated 07/02/2018, where to the psychiatrist in a hospital was authorized to issue a medical certificate for the hospitalization of patients with mental disorders. That is why this study focused on highlighting the role of the medical certificate in protecting the mentally ill in the Algerian legislation in accordance with the health law and general rules.
