قراءة في مفهوم المواطنة في التشريع الجزائري

Résumé: تتناول هذه الدراســــــــــة الإطار المفاهيمــــــــي والقانوني للمواطنة في النظام القانوني الجزائري، من خلال التعرض لتعريف المواطنة ومدى تكريسها في الدساتير الجزائرية المتعاقبة، وأيضا كيف نظمها المشرع في كل من القوانين العضوية والقوانين العادية، مـــــــــــــع التطرق إلى الحماية القانونية التي كفلها التشريع والتنظيم الجزائري من أجل ضمان ممارسة المواطنة الفعلية، وأيضـــــــــــــــا بيان أهم الحقـــــــــــــــــــوق التي جـــاء بها التعديل الدستوري لسنة 2016، إن المواطنــــــــــــــــة لا يمكن تجسيدها في أرض الواقــــــــــــــــع إلا بتوفير الضمانات والآليـــــــــــــات المناسبة لذلك، وفي الأخير نصل إلى أهم النتائج المستخلصة من هذه الدراســـــــــــــة. Abstract: this study deals with the conceptual and legal framework of citizenship in the Algerian legal system through exposure to the definition of citizenship and the extent to witch it is enshrined in the successive Algerian constitutions ,as well as how it was regulated by the legislator in both organic laws and ordinary laws ,with regard to the legal protection provided by Algerian legislation and regulation Ensure the exercise of effective citizenship, as well as the most important rights enshrined in the constitutional amendment for the year 2016, citizenship cannot be embodied in the ground only by providing the appropriate guarantees and mechanisms, and finally reach the most important results fromThis study.
