النطاق المادي والشخصي لتطبيق المادة الثالثة المشتركة بين اتفاقيات جنيف 1949، والبروتوكول الإضافي الثاني لعام 1977

Résumé: ملخص : يهدف القانون الدولي الإنساني إلى حماية ضحايا النزاعات المسلحة الدولية والنزاعات المسلحة غير الدولية، وتحتل هذه الأخيرة النسبة الأكبر من مجموع النزاعات المسلحة حاليا وتخلف النسبة الأكبر في عدد الضحايا خاصة المدنيين منهم. وتعد المادة الثالثة المشتركة بين اتفاقيات جنيف لعام 1949 والبروتوكول الإضافي الثاني لعام 1977 النصوص الأساسية التي تنظم هذا النوع من النزاعات وتحدد مجال تطبيقها المادي والشخصي، غير أن الفترة المعاصرة شهدت ظهور نزاعات مسلحة لا تندرج ضمن المفاهيم التقليدية للقانون الدولي الإنساني الخاص بالنزاعات المسلحة غير الدولية، مما يستوجب إعادة النظر في هذه المضامين أو النصوص بهدف توفير حماية أفضل للضحايا. Abstract: International humanitarian law aims to protect victims in international armed conflicts and non-international armed conflicts, of which the latter represents the greatest majority of current armed conflicts, and releases the largest number of victims, especially civilians. Article 3 common to the Geneva Conventions of 1949 and additional Protocol II of 1977 is the basic texts governing this type of conflict and defines the scope of its material and personal application. However, the contemporary period witnessed the emergence of armed conflicts that do not fall within the traditional concepts of international humanitarian law concerning non –international armed conflicts , Which necessitates a review of these contents or texts in order to provide better protection for the victims. .
