البطلان الشكلي في قانون الإجراءات المدنية والإدارية

Résumé: إن المشرع الجرائري عند تنظيمه للبطلان الشكلي في قانون الإجراءات المدنية والإدارية حاول أن يوازن بين نقطتين اساسيتين و هما فعالية البطلان كجزاء إجرائي لضمان احترام الشكليات الواجب إتباعها وبين ضمان حسن سير هذه الخصومة بما لا يغلب الجانب الشكلي إلى درجة إهدار الحق الموضوعي ، غير أنه في الواقع ضيق من حالات البطلان إلى درجة قد تؤثر على حقوق الدفاع المكفولة قانونا عندما لم يستثن الأشكال الجوهرية و المتعلقة بالنظام العام من قواعد البطلان الشكلي الأخرى المتعلقة بالمصلحة الإجرائية الخاصة بالأفراد . : Abstract The Algerian legislator when regulating the formel nullity in the civil and adminstative procedures law tried to balance two main points namely the effecativenss of nullity as procedural penalty to ensure respect for the formalities to be followd and the guarantee of proper conduct of this litigatoin so that the formal aspect does not prevail to the point of wasting the objective right reality is narrow of wasting the objective right reality is narrow of cases of invalidity to a degree that may affect the rights of defense guaranteed by law when it does not exclude essential formes and related to public order forme other rules of formel invalidity related to the procedural interest of individuals .
