الإطار التشريعي والتنظيمي للصيرفة الإسلامية في الجزائر

Résumé: خطت البنوك التجارية مسارا كبيرا في المجال المصرفي لتعاملاتها بالصيرفة الإسلامية سواء عن طريق تحولها إلى البنوك الإسلامية أو فتح المجال لنوافذ المنتجات المالية الإسلامية، وذلك من خلال الانتشار الواسع لها في مختلف الدول حيث أصبحت منافسا للصيرفة التقليدية. الهدف من هذه الورقة البحثية هو معرفة وتقييم واقع الصيرفة الإسلامية في الجزائر من خلال التعرف على إطارها القانوني والتنظيمي وعلاقاتها بالمؤسسات المالية، والوقوف على أهم الإشكالات التي تعيق سيرورة نشاطاتها المرسومة، ومن أجل تحقيق هذا الهدف تم تسليط الضوء على عدة جزئيات هامة ستثري دراستنا. Commercial banks have taken a great path in the banking field for their dealing with Islamic banking, whether by converting to Islamic banks or opening the way for Islamic financial products, through their wide spread in various countries, where they became a competitor to traditional banking. The aim of this research paper is to know and evaluate the reality of Islamic banking in Algeria by identifying its legal and organisational framework and its relations with financial institutions. Moreover, this study tries to identify the most important problems that impede the planned course of its activities, and in order to achieve this goal several important parts were highlighted that will enrich our research.
