Résumé: الملخص: تعتبر الوساطة القضائية إحدى الطرق البديلة لحل النزاعات القضائية في الجزائر، لجأت إليها الدولة بسبب الحجم الهائل للقضايا المرفوعة أمام مختلف الجهات القضائية من جهة و من جهة ثانية في محاولة لإيجاد سبل تسوية ودية ذات طابع رسمي و بإشراف القاضي المختص. إلا أن المتتبع للوساطة القضائية في الجزائر يدرك أن المسألة ليست سهلة و تحتاج إلى عمل كبير و تضافر عديد الجهود من أجل إقناع المتقاضين و تحسيسهم بأهمية الوساطة و إبراز دور الوسيط القضائي، و أنه من حقهم مواصلة دعواهم في حالة عدم التوصل لاتفاق يرضيهم. من خلال هذه الدراسة نتطرق لأهمية منصب الوسيط القضائي و صلاحياته ضمن قانون الإجراءات المدنية و الإدارية. Abstract: Judicial mediation is one of the alternative ways to resolve judicial disputes in Algeria. The state has resorted to it because of the huge volume of cases brought before the various judicial authorities on the one hand and on the other hand, in an attempt to find ways of amicable settlement of an official nature and under the supervision of the competent judge. However, the observer of judicial mediation in Algeria realizes that the matter is not easy and requires great work and concerted efforts in order to convince the litigants and make them aware of the importance of mediation and highlight the role of the judicial mediator, and that they can and have the right to continue their lawsuit in the event of not reaching an agreement that satisfies them. Through this study, we address the importance of the position of the judicial mediator and his powers within the Civil and Administrative Procedures Law.
