التقنين الفقهي

Résumé: التقنين الفقهي علم وفن ظهر في العصر الحاضر وهو يمثل دعوة ممنهجة بقواعد وأسس لضرورة إحلال القوانين المستمدة من الفقه الإسلامي مكان القوانين الغربية المستمدة من التركة الاستعمارية وذلك بإحداث تقنين مستمد من الفقه الإسلامي على جميع مذاهبه يكون على هيئة التقنين المعروف اليوم من حيث الترقيم والتبويب والضوابط ...ولذلك يتناول مقياس التقنين الفقهي مجموعة من العناصر أهمها المفهوم ومحاولات وجهود التقنين الرسمية وغير الرسمية في البلاد الإسلامية وصولا إلى حكم التقنين وبيان الخلاف فيه مع بيان بواعثه وضوابطه ن انتهاء بأثر الفقه الإسلامي في القوانين المدنية العربية . Jurisprudential codification is a science and art that has emerged in the present era. It represents a systematic call with rules and foundations for the necessity of replacing the laws derived from Islamic jurisprudence in the place of Western laws derived from the colonial legacy, by creating a codification derived from Islamic jurisprudence on all its schools of thought that is in the form of the codification known today in terms of numbering, tabulation, and controls. ...Therefore, the measure of jurisprudential codification addresses a group of elements, the most important of which is the concept and the official and unofficial attempts and efforts at codification in Islamic countries, leading to the ruling on codification and explaining the disagreement therein, with an explanation of its motives and controls, ending with the impact of Islamic jurisprudence on Arab civil laws.
