دور قانون الأسرة الجزائري في تحقيق الأمن الأسري (إنهاء الرابطة الزوجية أنموذجا) -دراسة مقارنة-

Résumé: "توضح هذه الدراسة الدور الكبير الذي لعبه قانون الأسرة الجزائري في المحافظة على أمن الأسرة واستقرارها، وذلك من خلال حماية حقوق أفرادها حال فك الرابطة الزوجية، وكانت هذه الدراسة وفق الإشكالية المطروحة كما يلي: إلى أي مدى وُفِّق المشرع الجزائري في تحقيق الأمن الأسري حال فك الرابطة الزوجية؟ وللإجابة على هذا الإشكال تم تسليط الضوء على مفهوم الأمن الأسري، ثم صور فك الرابطة الزوجية، ثم التطرق إلى أحكام كل من النفقة والحضانة في الفقه الإسلامي وقانون الأسرة الجزائري وإبراز علاقتهما بالأمن الأسري حال فك الرابطة الزوجية. ومن أهم النتائج المتوصل إليها في نهاية هذه الدراسة هي أن قانون الأسرة الجزائري كان همّه الوحيد تحقيق الأمن والأمان لأفراد الأسرة، من يوم انفكاك الرابطة الزوجية إلى غاية نيل الأسرة كافة حقوقها خطوة بخطوة، متّبعاً في ذلك أغلب أحكام الشريعة الإسلامية السمحاء، ومستنداً على أبرز قرارات المحكمة العليا من أجل الدفاع عن حقوق أفراد الأسرة بعد انفكاكها "This study explains the great role played by the Algerian family law in maintaining the security and stability of the family, by protecting the rights of its members in the event of dismantling the marital bond, and this study was according to the problem presented as follows: To what extent did the Algerian legislator in achieving family security in the event of dissolution of the marital bond? To answer this problem, the concept of family security was highlighted, then the pictures of the dismantling of the marital bond, then addressing the provisions of both alimony and custody in Islamic jurisprudence and the Algerian family law and highlighting their relationship to family security in the event of dismantling the marital bond. One of the most important results reached at the end of this study is that the Algerian family law was the only concern to achieve security and safety for family members, from the day of the dissolution of the marital association to the end of the family's achievement of all its rights step by step, following most of the provisions of the tolerant Islamic law, and based on the most prominent decisions of the Supreme Court in order to defend the rights of family members after their dissolution "
