الوضع القضائي في مؤسسة علاجية للمدمنين على المخدرات في التشريع الجزائري

Résumé: الوضع القضائي في مؤسسة علاجية للمدمنين على المخدرات والمؤثرات العقلية، ينفذ بناء على أمر أو حكم أو قرار قضائي، المتضمن وضع المتهم أو المحكوم عليه في هذه المؤسسة العلاجية، في حالة الإدمان الاعتيادي الناتج عن تعاطي المخدرات والمؤثرات العقلية، متى ثبت للجهة القضائية أن السلوك المتابع به الشخص المعني ناتج عن تناول تلك المواد. يهدف هذا التدبير إلى علاج المدمن من هذه السموم. الشيء الذي يجب أن نقف عنده في تنفيذ هذا التدبير من قبل القاضي الجنائي هو أن عدد المراكز المختصة في علاج الإدمان قليل على المستوى الوطني إذ يوجد مركزين على المستوى الوطني لعلاج الإدمان، وهو الأمر الذي يطرح إشكالية في تطبيق هذا التدبير من قبل القضاء الجنائي الجزائري. Judicial status in a treatment institution for drug addicts and psychotropic substances is implemented according to a judicial order, ruling, or decision, which includes placing the accused or convicted in this treatment institution, in the case of habitual addiction resulting from the use of narcotic drugs and psychotropic substances, when it is proven to the judicial authority that the behavior pursued The person concerned resulted from ingesting these substances. This measure aims to treat the addict from these toxins. The thing that we must stand with in the implementation of this measure by the criminal judge is that the number of centers specialized in the treatment of addiction is small at the national level, as there are two centers at the national level for the treatment of addiction, which raises a problem in the application of this measure by the Algerian criminal judiciary.
