الإلتزام بالإعلام وأثره في حماية المستهلك

Résumé: الملخص: يعتبر الإلتزام بالإعلام من أهم الإلتزامات المنصوص عليها في قانون حماية المستهلك المعدل و المتمم، حيث تكمن أهميته في ضبط التوازن المفقود في العلاقة بين المتدخل والمستهلك، كشف خبايا المنتوج وتبيان صفاته وخصائصه، وهذا من أجل تنوير إرادة المستهلك قبل أو أثناء أو بعد العقد. ونظرا لأهمية الموضوع و ضمانا لسلامة و حماية أمن المستهلك، فرض المشرع الجزائري على المخل بإلتزامه آليات وقائيه تمثلت في: إعلام المتدخل المستهلك بكل المعلومات المتعلقه بذاتيه المنتوج وسعره، وآليات جزائية تمثلت في قيام المسؤولية المدنية والعقدية على المتدخل، وفرض عقوبات إداريه و أخرى جنائية على كل من بسط سلطته على المستهلك. ورتب على مخالفة هذا الالتزام جزاءات إدارية ومدنية وجزائية . traduction: Compte tenu de l'importance de la question et pour assurer la sûreté et la protection de la sécurité du consommateur, le législateur algérien a imposé au contrevenant à son engagement des mécanismes préventifs représentés par : l'information du consommateur intervenant de toutes les informations relatives au produit et à son prix, et mécanismes pénaux représentés par l'établissement de la responsabilité civile et contractuelle de l'intervenant, et l'imposition de sanctions administratives et autres Une infraction pénale est infligée à quiconque exerce son autorité sur un consommateur.
