تجميد الأجنة البشرية كتقنية مساعدة على الإنجاب في الشريعة الإسلامية وقوانين بعض الدول العربية

Résumé: لقد تعاظم دور التكنولوجيا الحديثة الطبية في علاج الكثير من المشكلات ومن ذلك العقم، والذي طالما عانت منه الأسر، وكثيرا ما عصف باستقرارها، لذلك توصلت العلوم الطبية والبيولوجية إلى اكتشاف تقنية المساعدة على الإنجاب بغير الطريق الطبيعي والتي تعرف بتقنية التلقيح الاصطناعي والتي تحتاج بدورها إلى تقنيات مساعدة، منها تقنية تجميد الأجنة البشرية- موضوع بحثنا- الأمر الذي أثار العديد من الإشكاليات القانونية والفقهية والشرعية، والتي حاولت هذه الدراسات الوقوف عندها للخروج بأهم الضوابط والشروط الواجب مراعاتها حال القيام بهذه التقنية. The role of modern medical technology in treating many problems, including infertility, which has long plagued families and often disrupted their stability, has grown. Medical and biological sciences have discovered a technology that assists in reproduction outside the natural way, known as artificial insemination. This technology requires other assistive techniques, including the freezing of human embryos, which is the subject of our research. This has raised many legal, jurisprudential, and religious issues, which this study attempts to address in order to identify the most important controls and conditions that must be observed when using this technology.
