آليات حماية المياه الجوفية في ظل قانون المياه رقم 05-12 المعدل والمتمم

Résumé: تعد مشكلة المياه من المشاكل العالمية التي تخص جميع الدول دون إستثناء ،فالضرر الذي يلحقها يوجب على الجميع المساهمة الجادة في معالجته ،وفي ضوء المعلومات الموجودة عن إحتمال تزايد و تفاقم مشكلة تلوث المياه وتبذيريها وعلى وجه الخصوص المياه الجوفية بإعتبار أن التأثيرات السلبية على هذه الأخيرة ربما تؤثر كذلك على المياه السطحية ،سعت معظم الدول ومنها الجزائر إلى إيجاد مجموعة من التدابير القانونية الحديثة ووضع استراتيجيات وقوانين صارمة لحماية هذا المورد المائي وضمان توفيره وتنظيم إستغلاله وتقييد الأنشطة التي ربما تعرض وجوده ونوعيته للخطر، خاصة أن الجزائر تعد من الدول التي تعتمد على هذا النوع من المياه لتلبية حاجياتها من مياه الشرب ،الفلاحة والصناعة . تهدف هذه الدراسة إلى إبراز أهم تدابير الحماية التي تضمنها قانون المياه الجزائري، وذلك عن طريق تحليل مجمل النصوص القانونية التي جاء بها هذا القانون والمراسيم التنظيمية له. من أهم النتائج المتوصل إليها أن المياه الجوفية تعد من أهم المصادر للتزويد بالمياه الشرب وأن إستغلالها لأغراض أخرى لا بد أن يكون وفق إجراءات حددها قانون المياه، كما أن هذا الأخير وفر لها حماية خاصة لتجنب تلوثها . Abstract : The problem of water is a global problem that concerns all countries without exception. Damage to them requires everyone to a serious contribution to address it, and in the light of existing information on the possibility of increasing and exacerbating the problem of water pollution, especially groundwater, considering that the negative effects on the latter may also affect surface water , most countries including Algeria have sought to develop a set of modern legal measures and develop strict strategies and laws to protect this water resource, ensure its provision, regulate its exploitation and restrict activities that may endanger its existence and quality. Algeria is one of the countries that depends on this type of water to meet its needs of drinking water, agriculture and industry. This aims of this study is to highlight the most important protection measures included in the Algerian Water Law by analyzing the overall legal texts provided by this law and its regulatory decrees. One of the most important conclusions is the groundwater is one of the most important sources for supplying drinking water and its exploitation for other purposes must be in accordance with the procedures specified by the water law, and the latter has provided them with special protection to avoid pollution .
