النظام القانوني لطلب منح الصيغة التنفيذية للأحكام الأجنبية في التشريع الجزائري.

Résumé: يعد موضوع تنفيذ الأحكام الأجنبية من أهم مواضيع القانون الدولي الخاص، نظرا لما ينطوي عليه من إنفاذ للحقوق و تجسيد للعدالة، و الثابت أن المشرع الجزائري يسمح بتنفيذ الحكم الأجنبي في الجزائر، لكنه لم يساوي بينه و بين الحكم الوطني فهذا الأخير يكون قابلا للتنفيذ بمجرد صيرورته نهائيا، في حين يشترط لتنفيذ حكم أجنبي بالجزائر القيام بإجراء مسبق غير مألوف في إجراءات تنفيذ الأحكام الوطنية، إذ على صاحب المصلحة أن يطلب إمهاره بالصيغة التنفيذية طبقا للمادة 607 من قانون الإجراءات المدنية و الإدارية. إن المقصود بالطلب الوارد بالمادة سالفة الذكر هو عريضة دعوى قضائية وجاهية يقدم لاستصدار أمر قضائي و ليس ولائي، و أن هذه الدعوى تخضع لنفس إجراءات رفع الدعاوى المتعادة، و يتم ذلك أمام محكمة مقر المجلس التي يوجد في دائرة اختصاصها موطن المنفذ عليه أو محل التنفيذ و لا عبرة للترتيب من ناحية الإختصاص أو القبول. Abstract: The enforcement of foreign judgments is one of the most important subjects of private international law, because it involves the enforcement of rights and the embodiment of justice, The Algerian legislature allows the enforcement of foreign judgments on its territory, but it is not the same as national judgments, since the latter can be enforced once finalized, while the enforcement of foreign judgments in Algeria requires an unusual prior procedure in execution procedures, as the stakeholder must request for enforcement of judgment according to Article 607 of the Civil and Administrative Procedure Law. Means the above-mentioned request, a lawsuit and its procedure is the same as the usual procedure before the tribunal of chief seat of the court of the domicile of the prosecuted or execution place, and there is no value about the order for jurisdiction or receivability.
