طرق ابرام الصفقات العمومية في ظل المرسوم الرئاسي 15/247

Résumé: Abstract : Through our study of the issue of methods of concluding public deals under Presidential Decree 247/15, which includes the regulation of the Public Procurement Law. In order to improve the procedures followed in organizing and concluding public procurement, to ensure the efficiency of public requests and the best use of public money, principles must be observed in public procurement, and accordingly, violating these general principles exposes the contracting administration to accountability by the guardians and supervisory bodies. The Algerian legislator relied on the tender method as a general rule in the first law regulating public dealsHowever, in issuing Presidential Decree 247/15, he abandoned the tender and resorted to the request for proposals. Public deals are concluded in accordance with the procedures for the request for proposals, which constitutes the general rule, and thus it gives a wide scope for the administration to choose the method that suits it according to each contractual process, while obligating it to bear full responsibility. In the case of choosing a contracting method, there are four types of contracting by means of the request for proposals: the open request for proposals, the open request for proposals with the requirement of minimum capabilities, the limited request for proposals, the competition, or an exception according to the procedures of mutual consent in its two types, simple consent and consensual after consultation.
