متطلبات الأمن القانوني ودور المحكمة الدستورية في حمايته

Résumé: ملخص: يعتبر الأمن القانوني أحد اهم المواضيع التي حاول الفقهاء التطرق إليها لما لها أهمية من المساهمة في تكريس دولة القانون والمحافظة على الحقوق والحريات من خلال نشر الطمأنينة والثقة لدى الأفراد امام القواعد القانونية ، ولهذا نجد المؤسس الدستوري الجزائري حاول في عديد التعديلات الدستورية إلى التطرق لهذا المبدأ وهو ما تجسد صراحة في التعديل الدستوري لسنة 2020 الذي كان له نصيب كبير في النص على الأمن القانوني وكذا اعطاء دور فعال للمحكمة الدستورية في ضمان هذا المبدأ. لقد تطرق المؤسس الدستوري إلى مسألة النطاق الزمني لأثر قرارات المحكمة الدستورية في ما يتعلق بالدفع بعدم الدستورية في نص المادة 198 الفقرة الرابعة من التعديل الدستوري لسنة 2020 حيث جاءت صياغة هذه المادة على العموم مما يتيح للمحكمة الدستورية حرية تحديد زمن تطبيق قراراتها وفق ما تراه مناسبا لتحقيق مبدأ الأمن القانوني. Abstract: Legal security is considered one of the most important topics that jurists tried to address because of its importance in contributing to the consolidation of the rule of law and the preservation of rights and freedoms by spreading reassurance and confidence among individuals in front of legal rules. That is why we find the Algerian constitutional founder tried in many constitutional amendments to address this principle, which was explicitly embodied in the 2020 constitution, which had a great share in stipulating legal security, as well as giving an effective role to the Constitutional Court in guaranteeing this principle. The Constitutional Founder touched on the issue of the time scale for the impact of the Constitutional Court’s decisions regarding the defense of unconstitutionality in the text of Article 198, the fourth paragraph of the Constitutional Amendment of the year 2020, where the wording of this article came in general, allowing the Constitutional Court the freedom to determine the time for applying its decisions according to what it deems to achieve security legal .
