آليات استرجاع الأملاك العقارية الوقفية المفقودة في أحكام القانون الجزائري

Résumé: الملخص: انطلقت الدراسة بإبراز أهمية الوقف كنظام اجتماعي تكافلي، وكتجربة رائدة في الحضارة الاسلامية. ثم ركزت على الجهود التي بذلتها الجزائر لإعادة الأملاك الوقفية الى مكانتها الطبيعية، بالاعتراف بها وحمايتها وفق مبادئ الدستور والقانون. كما استندت الدراسة على الاجراءات القانونية لاسترجاع الأملاك الوقفية المفقودة. وكانت النتيجة أن الآليات القانونية المعتمدة تضمن اثبات واسترجاع أملاك الوقف، إذا تم الأخذ بها وتطبيقها بشكل صحيح. خاصة إجراءات مسح الأراضي والحفظ العقاري، وشهادة اثبات الملك الوقفي. Abstract : The study clarified the importance of the endowment (wakf) as a symbiotic social system. And as a pioneering experience in Islamic civilization. The study also focused on the efforts made by Algeria To restore the endowment property to its normal position, Through the principles of the Constitution and the legislation relating to its protection and proof. The study also shows the legal procedures for recovering lost wakf property. As a result, the legal mechanisms adopted ensure the proof and recovery of wakf property, If taken and applied correctly. Including surveying and real estate advertising procedures, And certificate of proving the wakf property.
