الحالات الموجبة لمسؤولية الإدارة في مجال الصفقات العمومية

Résumé: نتناول في هذه الدراسة متطلبات استحقاق التعويض في مجال الصفقات العمومية، والذي يعد كأثر ناتج عن الضرر اللاحق بالمتعامل المتعاقد في عقد الصفقة العمومية جراء نشاط الإدارة المتعلق بذات الصفقة، وذلك بتسليط الضوء على مختلف الحالات الموجبة لقيام مسؤولية الادارة وبالنتيجة التزامها بالتعويض في مجال الصفقة العمومية. توصلنا إلى أن قيام مسؤولية الإدارة وتحملها التعويض في مجال الصفقة العمومية، تتباين بين مسؤوليتها على أساس الخطأ كما هو الحال في اخلال المصلحة المتعاقدة بالتزاماتها التعاقدية، وكذا سوء استعمالها لسلطاتها الاستثنائية. إلى جانب قيام مسؤوليتها بدون خطأ، والتي تتجسد إما على أساس نظرية الإثراء بلا سبب، أو على أساس الحفاظ على التوازن المالي للعقد. In this study, we deal with the requirements for entitlement to compensation in the field of public Deals, which is considered as an effect resulting from the damage caused to the contracting dealer with the administration in the contracting of the public deal, by shedding light on the various cases requiring the administration's responsibility and as a result its commitment to compensation in the field of the public deal We concluded that the responsibility of the administration and its bearing of compensation in the area of the public deal varies between its responsibility on the basis of fault, as is the case in the contracting interest's breach of its contractual obligations, as well as its misuse of its exceptional powers. In addition to carrying out its responsibility without no fault, which is embodied either on the basis of enrichment without cause, or on the basis of maintaining the financial balance of the contract
