-حق الوصول الى المعلومة البيئية - بين الضمانات القانونية وفعالية الجمعيات البيئية في تطبيقه

Résumé: يعتبر الحق في الحصول على المعلومة البیئیة إحدى الحقوق الإجرائية لحماية البيئة، فهو يساهم في تعزيز الشفافية الادارية والمساءلة البيئية، و عليه اعتمدت العديد من الدول في منظومتها القانونية ضمن دساتيرها الوطنية و إقرار تشريعات دقيقة تسهل حق الحصول على المعلومات وإحاطته بالضمانات الكفيلة لممارسته ميدانيا، لأن الحصول على المعلومة البيئية ركيزة أساسية لتمتع ببيئة سليمة وصحية من خلال إعلام أفراد المجتمع بوضعية المحيط البيئي وطبيعة خصوصيته. ويتحقق ذلك بالاعتماد على نشاط الجمعيات البيئية لدورها الفعال في ممارسة هذا الحق بالتنسيق مع مختلف الهيئات العامة المعنية، على اعتبارها الأقرب إلى المواطن لعرض المعلومات التي تحصلت علیها من الجهات الإدارية المختصّة، ولفت الانتباه للقضايا التي أغفلتها أو تناستها الأجهزة التابعة لوزارة البیئة، وهذه المعرفة ستمكن المواطن من المساءلة القضائية بهدف الحفاظ على البيئة وحمايتها. The right of having the environmental information considered one of the procedures rights to save the environment, it contributes enhancing the administrative transparency and the environmental questionable. As result many countries based on constitution context in their legal system and create accurate announces simplify the right of the having the information and surrounding it by the assurance to the practical procedures. Because getting the environmental information is essential supportive to enjoy good and healthy environment through announcing the society by the position of the environment space and it is nature proprieties. And this achieved by basing on association activities for their effective role in practicing the right to coordinate with different public stuff meant for that , Because it is the nearest to the people to present the gotten information by the specialist management firm ,and draw attention the closed cased or being forgotten by the administrative ministry of the environment , and this knowledge will make the civilian having the right to sue for maintaining the environment and protect it
