الخصوصية الإجرائية للإثبات بالقرائن في الجرائم الجمركية

Résumé: يشكل إثبات الجرائم الجمركية بالقرائن أحد أهم خصوصياتها في سياق الإثبات، إذ أفرد لها المشرع الجزائري في قانون الجمارك رقم 17-04 أحكاما استثنائية تميزها عن باقي وسائل الإثبات الأخرى المعتمدة في الميدان الجمركي ويصلح أن تكون بها دليلاً قائمًا بذاته، وهي قرائن يتولى القانون تحديدها لتكون علامة لوقائع أخرى مجهولة، والمسألة الأساسية الملفتة للانتباه، أنّ المشرع اعتمد بشكل قوي عليها وإسنادها ماديًا ومعنويًا دون اهتمام توافر حسن النية أو ثبوت حالة الاشتراك في ارتكاب الجريمة الجمركية، بحيث يفترض بمقتضى هذه القرائن مسؤولية المخالف على ارتكابها أو الاستفادة بأي صفة من الغش الجمركي. Abstract: Proof of customs crimes by evidence constitutes one of their most important features in the context of proof. In Customs Law No. 17-04, the Algerian legislator singled out for them exceptional provisions that distinguish them from other means of proof approved in the customs field and that they may contain a stand-alone evidence. These are presumptions that the law determines to be A sign of other unknown facts, and the main issue that draws attention is that the legislator relied strongly on it and attributed it materially and morally without concern for the presence of good faith or proof of participation in the commission of the customs crime, so that under these presumptions the responsibility of the violator is assumed to commit it or benefit from any form of customs fraud.
