معاهدة حظر الاسلحة النووية لعام 2017 في ظل سياسة الردع النووي " من خلال نص المعاهدة والقضاء الدولي

Résumé: شكلت معاهدة حظر الاسلحة النووية التي دخلت حيز النفاذ بتاريخ 23/02/2020 حدث قانوني ذا أهمية بالغة في القانون الدولي، فهي بمثابة انتصار للمجموعة الدولية المناهضة والرافضة لإختبار وانتاج السلاح النووي، بل وتمتد الإرادة الدولية في هذا السياق إلى تحديد ومراقبة نقل التكنولوجية النووية التي قد تستغلها الجماعات الإرهابية، لتهديد الأمن والسلم الدوليين، ولا يتوقف الأمر عند الدول التي لم تدخل النادي النووي، والتي لم تصادق على الاتفاقيات ذلت الصلة، بل الأمر يتعلق بالدول النووية التي تملك ترسانة كبيرة للرؤوس النووية وتلوح بالاحتفاظ بحق الردع النووي، لهذا الغرض جاءت دراستنا للبحث في محتوى الاتفاقية وعلاقتها بسياسة الردع النووي. الكلمات المفتاحية: معاهدة حظر الاسلحة النووية، الردع النووي، القانون الدولي، الاتفاقيات الدولية. Abstract The Treaty on the Prohibition of Nuclear Weapons, which entered into force on February 23th 2020, constituted a legal event of great importance in international law, as it is a victory for the international group against and rejecting the testing and production of nuclear weapons. Terrorist groups may exploit them, to threaten international peace and security, and the matter does not stop with the countries that did not enter the nuclear club, and which did not ratify the relevant agreements, but rather the nuclear countries that have a large arsenal of nuclear warheads and threaten to retain the right of nuclear deterrence, for this purpose our study came To discuss the contents of the agreement and its relationship to the policy of nuclear deterrence.
