قواعد ومبادئ حماية البيئة الطبيعية زمن النزاعات المسلحة

Résumé: ملخّص: إنّ تعرّض البيئة الطّبيعيّة لأضرار بالغة زمن النّزاعات المسلّحة أمر لا مفرّ منه؛ فالحروب تركت آثارها المدمّرة على البيئة الطّبيعيّة؛ فغيّرت الحدود ومعالم الأنشطة الزّراعيّة، ودمّرت التّوازن في النّظم البّيئيّة، وقد استخدم تكتيك إحراق الأرض أثناء الحرب الأهليّة الأمريكيّة، ولطرد نابليون من روسيا، كما استعملت سياسة الأرض المحروقة من قبل الاستدمار الفرنسيّ في الجزائر، بالإضافة إلى تجاربه النّوويّة في صحرائها، ولا تزال لليوم بعض ميادين الحرب العالميّة الثّانية غير صالحة للاستغلال، أو تشكّل بالنّسبة للسّكان مخاطر جسيمة بسبب الأسلحة؛ خاصة الألغام والقذائف الّتي تملؤها، والعالم كلّه يشهد على ما يحدث اليوم من حرب إبادة جماعيّة وجرائم وانتهاكات جسيمة يرتكبها الاحتلال الصّهيونيّ ضدّ المدنيّين الفلسطينيّين وممتلكاتهم المدنيّة، وبحقّ البيئة الطّبيعيّة في قطاع غزّة بفلسطين المحتلّة، وغيرها من الحالات الّتي تتعرّض فيها البيئة الطّبيعيّة لتدمير واسع النّطاق. ولهذا، سعت الجماعة الدّوليّة جاهدة لوضع قواعد دوليّة خاصة بحماية البيئة زمن النّزاعات المسلّحة والحروب من خلال إبرام اتّفاقيّات خاصة بذلك؛ تتمثّل أساسا في اتّفاقيّات القانون الدّوليّ الإنسانيّ، وكذلك تساهم مبادئها في توفير الحماية القانونيّة للبيئة زمن النّزاعات المسلّحة، بالإضافة إلى العرّف الدّوليّ الملزم. Abstract: The natural environment suffers severe damage during armed conflicts. Causing harm to the environment in times of war is often inevitable. In fact, wars have always left devastating impacts on the natural environment, altering agricultural activities, changing borders, and disrupting the balance of ecosystems. For instance, the scorched earth tactic was used during the American Civil War and also to expel Napoleon from Russia. The French occupation of Algeria also applied this tactic, along with conducting nuclear tests in its desert. Some battlefields from World War II remain unusable or pose serious risks to residents due to weapons, especially landmines and unexploded ordnance. The world today witnesses ongoing acts of genocide, grave violations, and crimes committed by the Israeli occupation against Palestinian civilians, their properties, and the natural environment in the Gaza Strip of occupied Palestine. There are many other instances where the natural environment is subjected to widespread destruction. For this reason, the international community has made significant efforts to establish international rules for the protection of the environment during armed conflicts and in situations of military occupation. This has been done through the adoption of specific agreements, particularly those found in international humanitarian law. Furthermore, the principles of this law, along with binding customary international law, contribute to providing legal protection for the environment during armed conflicts.
