جریمة السرقة دراسة مقارنة في الفقهي الإسلامي وقانون العقوبات الجزائري

Résumé: هذا البحث عبارة عن دراسة تحلیلیة مقارنة بین موقف القانون الجزائري وموقف الفقه الإسلامي من جریمة السرقة و تعرضت من خلال هذا البحث المتواضع، لتعریف السرقة والاختلاس في الفقه الإسلامي والقانون العقوبات الجزائري. ثم حاولت المقارنة بین التعریفین ثم تعرضت لأحكام السرقة وأركانها وشروطها في الفقه الإسلامي و القانون العقوبات الجزائري. ثم میزت بین جریمة السرقة والجرائم المشابهة لها في كل من الفقه الإسلامي والقانون العقوبات الجزائري. ثم عرجت بشيء من التفصیل على أركان جریمة السرقة والاختلاس في الفقه الإسلامي والقانون العقوبات. ثم تكلمت عن عقوبة السرقة في الفقه و القانون الجزائري ، ووسائل إثبات هذه الجریمة وصفة هذه العقوبة و الحكمة من إقامتها.~ 6 ~ Summary This research is a comparative analysis between the position of the law and the position of the Algerian Islamic jurisprudence from crime and theft have been through this research humble , the definition of theft and embezzlement in Islamic jurisprudence and the Algerian . Penal Law Then I tried the comparison between the two definitions and then exposed to theft and tighten its corners and conditions in Islamic . jurisprudence and the Algerian Penal Law Then distinguish between a crime of theft and similar crimes in both . Islamic jurisprudence and the Algerian Penal Law Then put a little more detail on the elements of the crime of theft and . embezzlement in Islamic law and punishments She then worked as an attempt to compare between the pillars of . this crime under Islamic law and the Algerian Penal Then I spoke about the death of theft in Algerian law and jurisprudence , and the means to prove this crime and punishment .and the status
