الهجمات السبيرانية ومواجهتها في ضوء القانون الدولي المعاصر

Résumé: الملخص: أمام الثورة الرقمية الحديثة التي أفرزت وجود فضاء افتراضي يقوم على أساس بنية عالمية لتكنولوجيا المعلومات والاتصال، يثير موضوع الهجمات السبيرانية العديد من المشكلات القانونية في إطار القانون الدولي المعاصر، وفي هذا السياق يوجد عدة محاور تطرح نفسها للمناقشة والبحث حتى يمكن التوصل إلى حدود علاقة القانون الدولي بالهجمات السبيرانية، ومدى قدرته على التكيف والتعاطي معها. لذلك جاءت هذه الورقة كمساهمة في الجهد القانوني للإجابة على البعض من هذه الإشكالات، لاسيما تلك المتعلقة بالهجمات التي تصنف ضمن إطار الحروب السبيرانية، وكيف تعامل المجتمع الدولي مع مشكلة الفراغ القانوني الذي يشهده التنظيم الدولي في مواجهة وظهور هجمات سبيرانية جديدة مصدرها جهات فاعلة من غير الدول، أصبحت تشكل تهديدا خطيرا للسلم والأمن الدوليين. Absrract: Faced with the modern digital revolution that has resulted in the existence of a virtual space, based on a global structure for information and communication technologies, the subject of Cyber-attacks raises a large number of legal problems in the context of contemporary international law. In this context, several themes are needed for debate and research in order to reach the limits of the relationship between international law and cyber-attacks, and its ability to adapt and deal with them. Therefore, this bill contributes to the legal effort to answer some of these problems, especially those related to the attacks that are classified as part of Cyber- Wars, and how the international community has dealt with the legal vacuum problem, that the international organization knows in facing the emergence of new cyber-attacks, emanating from non-state actors, becoming a serious threat to the world peace and security.
