Résumé: من المعروف أن القاصر شخص ناقص الأهلية وعاجز على حماية نفسه والقيام بالتصرفات القانونية والمالية وحمايتها من الضياع مما أوجب على المشرع الجزائري، وضع نظام كفيل بحماية أموال القاصر، ما يعرف بنظام النيابة الشرعية والتي تتمثل في الولاية والوصاية، لكن المشرع لم يعطه السلطة المطلقة للتصرف فيها بل قام بتقيدها، ولكن في المقابل منح القاضي سلطة واسعة في تعيين النواب وتحديد مهامهم والتزاماتهم ومحاسبتهم عند تجاوز سلطتهم."The accepted that minor is an incapacitated person incapable to protect himself and practice the legal and the financial transaction, and protect them from the loss. That imposed the Algerian legislator to introduce an effective system to protect his assets from the loss and that is known as the legal reparative didn’t grant the guardianship and the custody, however, he limited it, and in return afforded the judge with an executive authority to appoint the deputies identify their functions and obligations and holding them accountable in abuse of authority.
