Résumé: الملخص: العرف وأثره في الفتوى من خلال كتاب الدرر المكنونة في نوازل مازونة باب العقود. الكلمات المفتاحية: العرف؛الفتوى؛ أثر؛ النوازل تهدف هذه الدّراسة إلى بيان أثر العرف ودوره في الفتوى والأحكام الشرعية الخاصة بباب العقود، ولا شك أن الموضوع يعالج مسألة مهمة في أصول الفقه المالكي، وهي مسألة تأثّر الفتوى والأحكام الشرعية بالأعراف والعادات الجارية في مختلف المجتمعات والبيئات، عبر كل زمان ومكان في ظل ما يشهده المجتمع من أعراف فاسدة أو صحيحة، ثابتة أو متغيرة، وقدجاء التساؤل الرئيسيللبحث كالآتي:ما مدى تأثير العرف واعتماده في دراسة النّوازل الفقهية الخاصة بالعقود عند المالكية؟ وما هو أثر تلك الفتاوى العرفية على واقعنا الحالي؟وللإجابة على هذا التّساؤلات اعتمدنا على المنهج التحليليلدراسة هذا البحث مستعينين بأداة الاستقراءلدراسة الجانب النظري للبحث، ثم بتتبع تلك الفتاوى المتعلقة بالعرف في كتاب الدرر المكنونة قصد دراستها وتحليلها وبيان أثر العرف فيها. وقد توصّلت الدّراسة إلى جملة من النتائج مفادها أن: العرف يقوم بدور هام في الحياة العامة،ويكاد لا يخلو جانب من جوانب الحياة من التأثر أو التأثير به، ومن أهم هذه الآثار نذكر: كونه مرجعا في فهم كلام الشارع والمكلف، معيارا في تحديد نطاق التصرفات، ضابطا في الأمور المطلقة والمجملة، دالا على الأمور الباطنة، كونه دليلا حيث لا دليل Title: Custom (Urf) and its impact on fatwas through the book of el dorar el maknouna fi NawazilMazouna, Chapter of Contracts. Keywords: custom; fatwa; Effect; Catastrophes This study aims to explain the impact of custom and its role in fatwas and legal rulings related to contractsThere is no doubt that the topic addresses an important issue in the principles of Maliki jurisprudence, which is the issue of how fatwas and legal rulings are affected by current customs in various societies and environments, across all times and places in light of what society witnesses of corrupt or correct, fixed or changing customs.The main question of the research was as follows: What is the extent of the influence of custom and its adoption in the study of jurisprudential issues related to contracts according to the Malikis? What is the impact of these customary fatwas on our current reality?To answer this question, we relied on the analytical approach to study this research, using the induction tool to study the theoretical side of the research, and then by tracking those fatwas related to custom in the Book of Hidden Pearls in order to study and analyze them and explain the impact of custom on them. The study reached a number of results stating that: Custom plays an important role in public life, and almost no aspect of life is devoid of being affected or influenced by it.Among the most important of these effects we mention: it being a reference in understanding the words of the legislator and the accountable, a standard in determining the scope of actions, a control in absolute and general matters, an indication of hidden matters, being a guide where there is no evidence...
