المبادئ الإنسانية في الحرب بين الفقه الإسلامي والقانون الدولي الإنساني (دراسة تأصيلية مقارنة)

Résumé: ملخص: تتناول الدراسة المبادئ الإنسانية أثناء الحرب كما قررها الفقه الإسلامي من خلال نصوص الكتاب والسنة وأقوال الفقهاء، ومن هذه المبادئ، مبدأ التمييز بين المقاتلين وغير المقاتلين، ومبدأ حظر أو تقييد استخدام بعض أنواع الأسلحة، ثم مبدأ مراعاة القواعد الإنسانية في معاملة الأعداء مُرَجِّحَةً ما يبدو بالدليل رُجْحَانُهُ، ومن ثَمَّ مُقَارنتها بما توصلت إليه قواعد القانون الدولي الإنساني من مبادئ وأحكام . Abstract The study addressed the principles of humanity during the war in Islamic jurisprudence by the texts of the Quran and Sunnah and sayings of the jurists, and these principles, the principle of distinction between combatants and non-combatants. And the principle of the prohibition or restricting the use of certain types of weapons. Then, the principle of observance the principle of humanitarian rules in the treatment of enemy, and then compare them with the rules of international humanitarian law and of the principles and provisions.
