Résumé: المتمعن في خبايا القانون البحري الجزائري وحتى القوانين المقارنة كالقانون البحري الفرنسي، نجد أن هذه القوانين تضم في طياتها كتابا خاصا متعلق بالأحكام الجزائية الناتجة عن مخالفة أحكام الملاحة البحرية والمينائية، ضف إلى ذلك وجود بالمجال البحري جرائم خاصة لا يمكن لقانون العقوبات كقانون عام على معالجتها وهو الأمر الذي أدركه المشرع الجزائري في تعديل القانون البحري بموجب قانون 98/05 A closer look at the subtleties of the Algerian maritime law and even comparative laws such as the French maritime law, we find that these laws include in their folds a special book related to the penal provisions resulting from the violation of the provisions of maritime and port navigation, in addition to that in the maritime domain there are special crimes that the penal code as a general law cannot deal with, which is a matter that The Algerian legislator realized it in amending the maritime law under Law 98/05
