Résumé: على الرغم من أن هناك أسبابا موضوعية تدعو إلى تحرير المعاملات التجارية الدولية من سلطان القوانين الداخلية وضرورة إخضاعها للقانون عبر الدولي ، إلا أن جانبا من الفقه مازال ينكر على القانون التجاري الدولي الصفة القانونية . يعتبر القانون التجاري الدولي حقيقة واقعية وذلك لتوافره على العناصر الضرورية لقيام نظام قانوني معين ، إلا أنه لا يزال في طور التكوين وفي بداياته يشوبه بعض النقص والقصور يمكن تكملته بموجب القوانين الوطنية وذلك من خلال منهج التنازع ، وهو ما يبرز بوضوح العلاقة التكاملية بين كل من القانون التجاري الدولي ومنهج التنازع .
