الابتكار المصرفي الاسلامي في ظل ضوابط الرقابة الشرعية

Résumé: ملخص: تهدف هذه الورقة إلى دراسة واقع النشاط الابتكاري في المصارف الإسلامية وذلك في ظل ضوابط وأحكام الرقابة الشرعية، أين سلطنا الضوء على دور وأهمية الرقابة الشرعية في إيجاد منتجات وأدوات مالية مبتكرة تجمع بين الكفاءة الاقتصادية والمصداقية الشرعية. وتم التطرق في هذه الدراسة إلى مفهوم وواقع الابتكار المصرفي الإسلامي والمنتجات المالية الإسلامية وأهمية تطويرها، كما تطرقنا إلى أساسيات حول الرقابة الشرعية والتحديات التي تواجهها، وأخيرا تناولنا ضوابط الابتكار وأساليب دعمه في ظل الرقابة الشرعية، وكذلك واقع الصناعة المصرفية الإسلامية في الجزائر. وتوصلنا في الأخير إلى أن الاحتكام للشريعة ومعاييرها لا يحد من الابتكار، فالشريعة الإسلامية ترفض الممنوع، ولكنها لا ترفض الإبداع. Abstract: The aim of this paper is to study the reality of innovation in Islamic banks under the provisions of legitimate overstight, through this paper we will highlight the role and importance of legitimate oversight in creating innovative products and financial instruments, combining economic efficiency with legitimate credibility. The study focused on the concept and reality of Islamic banking innovation and Islamic financial products and the importance of developing them, We also discussed the basics of legitimate overstight and the challenges it faces, Finally, we discussed the determinants of innovation and its support methods under the legitimate oversight, As well as the reality of the Islamic banking industry in Algeria. Finally, we found that the adoption of Sharia and its standards does not limit innovation, Islamic law rejects the prohibition, but it does not reject innovation.
