أحكام الشكلية في الوعد بالتعاقد في ظل القانون المدني الجزائري

Résumé: يحتل موضوع الشكلية في الوعد بالتعاقد أهمية بالغة في إثبات جميع المواد المدنية والتجارية والأحوال الشخصية....الخ , ولقد أحاطها المشرع الجزائري أهمية وحماية خاصة مزيلا الغموض علي اللبس الذي وقع فيها مع ضرورة توفر ركن الشكلية في الوعد بالتعاقد تحت طائلة البطلان وهذا ما جاءت به المادة 71 من القانون المدني حيث ألزم المشرع المتعاقدين على صب اتفاقاتهم الودية في قالب رسمي ولم يكتف بفرض الشكلية في العقود النهائية الباتة , بل ألزم المتعاقدين بان تتم هذه الشكلية في العقود الابتدائية وفي مقدمتها الوعد بالبيع علي سبيل المثال وعليه فلقد راعى المشرع خصوصية الوعد بالتعاقد وآثاره من الناحية القانونية . Abstract : The theme of “Formalism In the promise of Contracting” occupies an extreme importance in proving all civil and commercial matters and personal status .... etc, and the Algerian legislature has surrounded it of particular importance and protection; thereby eliminating ambiguity on the confusion that occurred in it, with the necessity of providing the condition of "Formalism In the promise of Contracting " under penalty of nullity. This is what is stipulated in Article 71 of the Civil Code where the legislature has not only imposed formalism in the final unqualified contracts; but also it (legislature) obliges the contractors that these formalities are in the primary contracts, particularly the promise to sell, for example.
