اللجان الدولية كآلية حماية للمهاجرين في القانون الدولي

Résumé: عرف القانون الدولي المعاصر آلية اللجان الدولية منذ بداية نشأته، كما تبنت الممارسة الدولية هذه الآلية في العديد من السوابق الدولية أين تم اللجوء لها كوسيلة لحل أو تسوية النزاع القائم، وتأتي هذه المقالة لاستعراض وتحليل دور اللجان الدولية في عملية حماية المهاجرين وفق قواعد القانون الدولي، هذا الأخير الذي اعترف لفئة المهاجرين بنظام حماية متكامل يشمل العديد من الحقوق عبر مختلف مراحل عملية الهجرة وكذا الوضعيات التي يكون فيها المهاجر، ونظرا لقلة الدراسات في هذا الصدد فقد حاولت هذه المقالة في الجزء الأول منها الكشف عن الطبيعة القانونية لهذه الآلية عبر استعراض محاولات التعريف التي قدمها الفقه في هذا الشأن والخصائص التي خلص إليها حول اللجان الدولية، كما تتناول هذه المقال بشكل من التحليل أهم نوعين من اللجان الدولية في مجال حماية المهاجرين، وهما اللجان الدولية للمتابعة وهي التي تتابع تنفيذ القوانين المتعلقة بالمهاجرين واللجان الدولية للتحقيق التي تتولى عمليات التحقيق في الإدعاءات بانتهاك حقوق المهاجرين، وذلك عبر استعراض إجراءات وصلاحيات كل نوع من هذه الأنواع، وفي الجزء الثاني من المقالة نتناول الآثار الناجمة على حماية المهاجرين بموجب اللجان الدولية وذلك عبر استعراض إسهامات هذه العملية في تطوير نصوص القانون الدولي، وتنتهي المقال إلى تقييم شامل لدور اللجان في هذا الموضوع عبر التطرق لكل من إيجابيات وسلبيات هذه الآلية في مجال حماية المهاجرين. The present article studies the most important legitimate investment mechanisms of Islamic banks funds such as sleeping partnership, participation, resale with a stated profit, forward buying and contract for manufacture as the appropriate Islamic alternatives for interest-based conventional banks in accordance with the provisions of the law and its fair in financial transactions and the protection of the nation from the effects of social usury and its economic harms, which warns a war from Allah and his messenger on its dealers. In order to achieve the purpose of investing in Islam which aims at exploring the wealth and resources that God created on this earth, or obtain them and employ them in ways that lead to their increase, development, utilization and conservation, the Islamic jurisprudence formulas provided us with a variety of investments forms and shapes that suit different categories, different circumstances and fields. This is so to be a help for the one of experience who is able to work and tender, unlike investment usurious formula which is basically based on the interest rate and which has one formula despite its numerous forms, it favours the royal wealthy category and protect it against risks while it exposes winning funding alone risks whatever the outcome of his project.
