التضامن بين الموقعين في السفتجة الإلكترونية و الشيك الإلكتروني Solidarity Between The Signatories Of The Electronic Bill And The Electronic Check

Résumé: تناولنا بالدراسة موضوع التضامن بين الموقعين في الأوراق التجارية الإلكترونية، و بالأخص في السفتجة الإلكترونية و الشيك الإلكتروني باعتبارهما من أبرز الضمانات للوفاء بقيمتهما، و ذلك من خلال البحث في مدى قيام التضامن الذي يستهدف كهدف أساسي حماية الحقوق، و الحصول على قيمة الورقة التجارية. و إجمالا لذلك، فإن خضوع السفتجة الإلكترونية لأحكام التضامن الصرفي لا يجد تطبيقه سوى في السفتجة الإلكترونية الورقية دون السفتجة الإلكترونية الممغنطة، و أمام غياب نص تشريعي يقر ذلك صراحة فإن الحديث عن هذا التضامن الصرفي بين الموقعين في مجال السفتجة الإلكترونية مستبعد الحديث كونه أمر في غاية الصعوبة و التطبيق، فضلا عن حكم تطبيق هذا التضامن في مجال الشيك الإلكتروني، إذ يجوز للمستفيد بموجبه مطالبة أي موقع على الشيك الإلكتروني بقيمته دون مراعاة أي ترتيب معين. In the study, we dealt with the issue of solidarity between the signatories of electronic commercial papers, especially in the electronic bill and electronic check, as they are among the most prominent guarantees for the fulfillment of their value, by researching the extent to which solidarity is established, which aims as a primary goal to protect rights, and obtain the value of the commercial paper . In sum, the subjection of electronic bills to the provisions of morphological solidarity finds its application only in the paper electronic bills without the magnetic e- bills, and in the absence of a legislative text explicitly acknowledging this, the talk about this morphological solidarity between the signatories in the field of electronic bills is excluded because it is a very important matter, Difficulty and application, as well as the rule of applying this solidarity in the field of electronic check, whereby the beneficiary may claim any signer on the electronic check for its value without taking into account any particular arrangement.
