بطلان الصفقة العمومية على ضوء التشريع الجزائري

Résumé: ملخص: نظرية البطلان من النظريات الهامة والمعقدة في القانون المدني، تزداد تعقيدا في القانون العام إذ إن نطاق النظام العام في زيادة وتوسع، وان أسباب البطلان تتضاعف فالتشريعات واللوائح الصادرة عن السلطات المختصة لم تترك لإرادة المتعاقدين إلا مجالا محددا، بحيث نشا ما يسمى بالعقد المفروض، وهو العقد الذي تكون جل شروطه وأحكامه مقدرة مقدما ومملاة على المتعاقدين ، فمبدأ استقرار العقود لم يعد مطلقا إذ إن العقد في القانون المعاصر يعد قرارا في نشأته وتنفيذه ،فكثيرا ما يتدخل المشرع اما مباشرة أو بواسطة القضاء لكي يعيد تنظيم اثاره رغم أن العقد يلزم الطرفين المتعاقدين، ومن ثم فان للبطلان في الصفقة العمومية كعقد من العقود الإدارية خصوصيته التي ينماز بها عن بطلان العقود في القانون الخاص. الكلمات المفتاحية: البطلان؛ الصفقة؛ التشريع الجزائري : Abstract The theory of invalidity of important and complex theories in civil law is becoming more complicated in public law as the scope of the public order increases and expands, and the reasons for invalidity multiply.
