Résumé: الملخص قواعد المسؤولية المدنية عن الأضرار الناتجة عن استخدام الكائنات الحية المحورة جينيا تعتبر وسيلة علاجية لمثل هذه الأضرار التي تمس التنوع البيولوجي والصحة العامة ، حيث تضمنها بروتوكول ناغويا كوالالمبور الذي تأخر صدوره عن بروتوكول قرطاجنة باعتباره البروتوكول الأصلي بسبب المفاوضات حول حالات المسؤولية المدنية عن استخدام الكائنات الحية المحورة التي يمكن إقرارها في البروتوكول، ثم تطرقت إلى التوجيهات الأوربية، لأن دول الاتحاد الأوربي تتبنى نظاما صارما في التعامل مع الكائنات المحورة وراثيا، لذلك سنتطرق في الدراسة إلى البحث عن حالات قيام المسؤولية المدنية عن استخدام الكائنات المحور وراثيا، وأساسها القانوني، الجزاء المترتب في حالة الإضرار بالبيئة عموما . Summary Civil liability rules for damages resulting from the use of genetically modified organisms are considered a remedy for such damages affecting biological diversity and public health, as they are included in the Nagoya Kuala Lumpur Protocol, whose issuance was delayed from the Cartagena Protocol as the original protocol due to negotiations on cases of civil liability for the use of LMOs. Which can be approved in the protocol, and then touched upon the European directives, because the countries of the European Union adopt a strict system in dealing with genetically modified organisms, so we will discuss in the study cases of civil liability for the use of genetically modified organisms, and their legal basis, the penalty entailed in the case of Damaging the environment in general.
