أثر النقد الفقهي في تكوين الملكة اللغوية ومعرفة أسرار الكلام

Résumé: ملخص: العلاقة بين الفقه الشرعي واللغة العربية كبير، فالقرآن نزل بلسان العرب، مما جعل العربية مفتاح الدين، ولقد اجتهد العلماء كثيرا في ترجيح حكم فقهي على آخر بناء على اللغة العربية، واستنادا إلى نحوها وصرفها واختيار مفرداتها، واستعمال ظواهرها كالمترادفات والأضداد وكذلك تراكيبها، وفي عملهم هذا يرجعون إلى نصوص القرآن والسنة فتكون البلاغة واللغة في كثير من المسائل فيصلا قاضيا بفض النزاع وترجيح حكم على آخر وتقوية قول على قول غيره، من هنا يهدف البحث إلى تجلية هذه العلاقة بما يعكس للمتلقي أثر الخلاف المذهبي وترجيحات المجتهدين في تعلم اللغة العربية والإحاطة بها، من جهة، ويبين من جهة أخرى سمو هذه اللغة ومدى استيعابها ودقتها وعمق دلالاتها وتنوع استعمالاتها. كلمات مفتاحية: أثر، الاختلاف، الفقهي، تكوين، الملكة اللغوية، أسرار الكلام. Abstract: The relationship between Islamic jurisprudence and the Arabic language is great, for the Qur’an was revealed in the tongue of the Arabs, which made Arabic the key to the religion. These refer to the texts of the Qur’an and the Sunnah, so that rhetoric and language are in many issues, and it is a judge to settle the dispute, prefer a ruling over another, and strengthen one saying over another. From here, the research aims to clarify this relationship in a way that reflects to the recipient the impact of the doctrinal dispute and the preferences of the diligent in learning and understanding the Arabic language. On the one hand, and on the other hand, it shows the loftyness of this language and the extent of its comprehension, accuracy, depth of connotations, and the diversity of its uses.
