التحكيم كآلية إجرائية في منازعات عقود الاستثمار

Résumé: يروم هذا البحث إبراز أهمية التحكيم في منازعات عقود الاستثمار ، بوصفه نظاما مناسبا يتم اللجوء إليه كآلية مرغوب فيها لتسوية منازعات الاستثمار بين الدولة المضيفة والمستثمر الأجنبي لما يحققه من ضمان لحقوق أطراف العقد . و يتسم التحكيم في منازعات الاستثمار بخصوصية تميزه عن باقي الوسائل الأخرى، مردها تباين المراكز القانونية لطرفي المنازعة الاستثمارية ، أي الدولة المضيفة بما تتمتع به من سلطة وسيادة، و هي شخص من أشخاص القانون العام ( المركز الأقوى) ، والطرف الآخر (الحلقة الأضعف) و هو في الغالب شخص طبيعي أو معنوي من أشخاص القانون الخاص ، وأيضا العملية الاستثمارية محل العقد ، حيث أنه مرتبط باستثمارات ضخمة تتعلق بالركائز الاقتصادية الاستراتيجية للدولة وما يستغرق من سنوات لتنفيذها مع تشابك العلاقات المتعلقة به، لذلك كان حقيق على التحكيم بما يتمتع به من مزايا أن يكون القضاء الطبيعي لفض منازعات هذه العقود. الكلمات المفتاحية : التحكيم التجاري ، المنازعات الاستثمارية ، المستثمر الأجنبي ، عقود الاستثمار ، العملية التحكيمية. This research aims to highlight the importance of arbitration in investment contract disputes as an appropriate system to be used as a suitable mechanism for settling investment disputes between the host State and the foreign investor for securing the rights of the parties of the contract. Arbitration in investment disputes is characterized by a special peculiarity that distinguished it from other means, due to the divergent legal positions of the two parties of the investment dispute, i.e. the host State with its authority and sovereignty, as a person of public law (with a stronger status) and the other party (the weakest link) and he is often a natural or moral person of private law, as well as the investment process in question, since he is linked to huge investments in the strategic economic pillars of the State and the years to be implemented with the interrelationship with him. The arbitration therefore should have been the natural jurisdiction for the resolution of disputes over these contracts due the benefits it enjoy.
